Section 50.07 Development Standards

A development standards matrix is hereby established which indicates the property development standards to be applied to permitted land uses. Commercial uses shall be subject to development standards described in this Section and those standards in Chapter 8 (General Standards of Development)

Section 50.08 Signs
Each lot or parcel of land may have the following signs pursuant to the provisions of Part 87 (Signs):
  1. Accessory signs advertising the business conducted, services rendered, or the goods produced or sold on the premiss on which the sign is located, as provided in Section 87.17.

  2. Each legally established use may have one (1) additional accessory sign not to exceed six (6) square feet in area.

  3. Other signs as provided in Part 87 (Signs).

Section 50.09 Special Development Standards
The following special standards apply to land uses within each Zone:

Mixed Use Residential Commercial Zone (M-U)
  1. Outside Storage: The maintenance of an open storage area at the rear of the property in connection with the operation of a business otherwise required to be within an enclosed building is permitted, provided such storage area is completely enclosed by a solid masonry wall no less than six (6) feet in height and where all articles stored therein are completely shielded from view from outside the property. The Commission may approve the substitution of a decorative fence or masonry wall or any combination thereof, where, in the opinion of the Commission, such fence or wall will adequately comply with the objectives of this Section. All requests for substitution shall be subject to the provisions of Part 105 (Site Plan Review). Such storage area shall not be open to the public, and sales operations shall not be conducted on or at such area.

  2. Walls: Each lot or parcel of land in Zone M-U which has a side or rear lot line adjoining property in a residential or agricultural zone shall have a solid masonry wall, not less than six (6) feet in height nor more than seven (7) feet established along said side and rear lot lines adjoining said zones, except as otherwise provided in Part 88 (Special Development Standards).

  3. Residential-Commercial Design Criteria: The following design criteria shall apply to all development within the Mixed-Use Zone.
    1. Residential uses may be constructed above existing commercial facilities or as a separate structure attached to or adjacent to the commercial facilities.
    2. The commercial and residential uses shall have an integrated site plan and architectural design so as to appear to be one uniform, related development.
    3. Residential-Commercial Design Criteria include the following:
      1. Commercial buildings shall have building walls with large windows which come up to the sidewalk forming a strong edge to the street.
      2. The residential portions of buildings shall be set back from the street or adjacent property lines to buffer residences from noise and allow light and air to reach living units.
      3. Entrances to buildings shall be inviting, shall occur often and shall be slightly recessed along the building frontage.
      4. Parking is required to be located behind buildings so that people on the street are greeted by shopfronts and not parking lots.
      5. Walls on property lines between residential and nonresidential or mixed use shall be a minimum of 8 feet high to provide a buffer between adjacent uses.
Service and Professional Zone (C-S)
  1. Outside Display. All display and storage in Zone C-S shall be located wholly within an enclosed building except for parking lots.

  2. Walls. Each lot or parcel of land in Zone C-S which has a side or rear lot line adjoining property in a residential or agricultural zone shall have a solid masonry wall, not less than five (5) feet in height nor more than six (6) feet in height, established along said side and rear lot lines adjoining said zones, except as otherwise provided in Part 88 (Special Development Standards).
Medium Commercial (C-3) and Heavy Commercial (C-4)
  1. Commercial Manufacturing (C-M)
  1. Accessory Outdoor Storage: Outdoor storage is permitted on the rear of a lot or parcel of land when such storage is strictly incidental to the permitted use existing in a building on the front portion of the same lot or parcel of land and provided no storage is higher than the enclosure surrounding it nor nearer than fifty (50) feet to the front property line. Any outdoor area used for storage shall be completely enclosed by a solid masonry wall, not less than five (5) feet nor more than six (6) feet in height, except that Commission may approve the substitution of a fence or decorative wall where, in the opinion of said Commission, such wall or fence will adequately comply with the provisions of this Section. All such requests for substitution shall be subject to the provisions of Part 105 (Site Plan Review).

  2. Fences and Walls: Each lot or parcel of land in Zone C-M which has a side or rear lot line adjoining property in a residential or agricultural zone shall have a solid masonry wall, not less than five (5) feet in height nor more than six (6) feet in height, established along said side and rear lot lines adjoining said zones, except as otherwise provided in Part 88 (Special Development Standards).
